Bert van Delen’s Genderkliniek is unique in the world and operates legally by advising and referring clients to foreign clinics for sex selection. It is the gateway to get what they want for people living in countries where governments interfere with the most basic freedoms.
In the USA, Russia, Middle East and many other countries, gender selection is no point of debate at all and legally accepted reflecting various ethical frameworks on reproductive freedom.
As no prohibited medical procedures are performed domestically, despite much upheaval, the practice found to be compliant with applicable local legislation
While public debate and absent minded media often frames this as a “grey area” due to the evasion of local prohibitions, Van Delen, a legal expert and journalist, has designed his service in a way to operate flawless within legal boundaries.
Thirty years ago, Bert van Delen left journalism, quit his job at the lawyers office and became almost instantly a recognized player in the medical field. De Genderkliniek was born.
It all came by coincidence. While working at a UK lawyers office he advised clients seeking new opportunities and investments. At a certain moment, the idea was born to copy the successful London Gender Clinic to The Netherlands.
Initially Bert was responsible for the media briefings only.
In the beginning, on going media attention caused a lot of pressure on the management. Soon it emerged Bert was the one and only with the guts to run the entire operation. No pain, no strain.
During the first years, De Genderkliniek specialized in gender selection through sperm sorting only. Later on De Genderkliniek was forced to close the facility in Utrecht and moved to Belgium and the UK. As due to European legislative changes operations came to an end, treatments happen since 2010 in the US and Cyprus.
With this move De Genderkliniek introduced a far better but also more invasive and expensive technology, named Embryo selection.
Van Delen’s legal background explains how he later approached legislative questions.
When regulators clamped down on sperm selection within the Netherlands, he treated the issue like an international trade dispute bypassing local constraints by legally shifting the supply chain and consumer routing to clinics abroad.
Before entering the workforce, Van Delen completed his studies at law school.
His identity as a legal adviser is clearly visible in how he manages De Genderkliniek. Rather than operating as a medical doctor, he acts as a legal strategist for his clients.
Waterproof Design: De Genderkliniek never crosses into illegal medical territory within the Netherlands, Belgium or other countries. As a matter of fact: De Genderkliniek is just a name for a website providing information. It actually doesn’t exist as a real clinic.
Independent professional health care providers from around the world perform all pretesting and scans. They get directives straight from embryologists abroad.
As long as Dutch and European law do not penalize providing information or cross-border referrals the operating model is legally bulletproof against any state intervention.
